Terms of Service

1. Acceptance

By downloading, installing, or using Clarity ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms are between you and Ian Phillip, an independent developer ("we," "us," "our").

2. What Clarity is (and is not)

Clarity is a personal thinking partner. It uses structured frameworks and Socratic questioning to help you explore decisions, articulate values, and develop goals.

Clarity is not a substitute for professional advice. It does not provide medical, psychological, legal, financial, or therapeutic services. If you are in crisis or need professional help, please contact a qualified professional or emergency service.

Responses are generated using pattern-matching and pre-authored content — not a general-purpose AI model. The quality and relevance of responses may vary.

3. Eligibility

You must be at least 13 years old to use Clarity. If you are under 18, you confirm that you have the consent of a parent or legal guardian.

4. Your account and data

Clarity does not require account creation. Your profile, conversations, and preferences are stored locally on your device using Apple's SwiftData framework. We do not have access to this data. You are solely responsible for maintaining backups of your device.

5. Subscriptions and billing

Clarity offers three tiers:

Paid subscriptions are billed monthly through your Apple ID. By subscribing, you authorize Apple to charge the applicable fee to your payment method on file.

Auto-renewal

Paid subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price.

Free trials

Paid tiers include a 7-day free trial. If you cancel before the trial ends, you will not be charged. If you do not cancel, your subscription will begin at the end of the trial period.

Managing subscriptions

You can manage or cancel your subscription at any time in your device's Settings → [Your Name] → Subscriptions, or through the App Store. Cancellation takes effect at the end of the current billing period — you retain access until then.

Refunds

Refunds are handled by Apple in accordance with their refund policy. We do not process payments or refunds directly.

Clarity, its design, frameworks, content, and branding are owned by Ian Phillip and protected by copyright and trademark law. You retain ownership of any personal content you create within the App (your conversations, values, goals).

You may not use the Clarity name, logo, or visual identity without our prior written permission.

8. Disclaimer of warranties

Clarity is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the App will be error-free, uninterrupted, or that any content will be accurate or reliable. You use the App at your own risk.

9. Limitation of liability

To the maximum extent permitted by applicable law, Ian Phillip shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the App.

Our total liability for any claim arising from these Terms or the App shall not exceed the amount you paid to us in the 12 months preceding the claim, or $50 USD, whichever is greater.

10. Indemnification

You agree to indemnify and hold harmless Ian Phillip from any claims, damages, or expenses arising from your use of the App or violation of these Terms.

11. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated through the App or App Store release notes. Continued use of the App after changes constitutes acceptance. If you disagree with updated Terms, stop using the App and delete it from your device.

12. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in San Francisco County, California.
